Your Privacy Rights Under GDPR

MyRentis committed to protecting your personal data in accordance with the EU General Data Protection Regulation (GDPR) and Malta's Data Protection Act (Chapter 586). You have rights over your data, and we respect those rights.

1. Data Controller

MyRent operates as the data controller for personal information collected through our platform. We are based in Malta and operate in accordance with EU and Maltese data protection laws.

MyRent has not appointed a Data Protection Officer as we do not meet the criteria for mandatory appointment under GDPR Article 37. The contact above is your point of contact for all privacy matters.

Supervisory Authority

The supervisory authority in Malta is the Information and Data Protection Commissioner (IDPC). You have the right to lodge a complaint with the IDPC at any time.

2. Information We Collect

2.1 Account Information

When you create an account, we collect:

  • Name and email address
  • Phone number (if you choose to provide it)
  • Account credentials

Providing your name and email address is necessary to create an account and use the platform. If you do not provide this information, we cannot provide you with the service.

2.2 Listing Information

When you create a property listing, we collect and process:

  • Property details (description, location, price, features)
  • Property images you upload
  • Contact information you choose to display publicly

We may review and moderate listing content (including images) to enforce our platform rules and remove or restrict content that we consider inappropriate, unlawful, or harmful. Such moderation is carried out under our legitimate interest in keeping the platform safe and compliant.

⚠️ Public Information Notice

Contact details you include in listings (phone numbers, email addresses) will be publicly visible to all platform visitors. Only include information you are comfortable sharing publicly. Once published, this information may be indexed by search engines and shared on social media as part of our platform operations.

2.3 Technical Information

We automatically collect:

  • IP address and browser information
  • Device type and operating system
  • Usage data and navigation patterns
  • Cookies and similar tracking technologies (see Section 5)

3. How We Use Your Data

We process your personal data only for specific purposes and only where we have a lawful basis to do so under GDPR Article 6. The table below maps each activity to its legal basis.

Account creation and management

Legal basis: Contractual necessity — Art. 6(1)(b). Processing your name, email, and credentials is necessary to provide you with the platform service.

Publishing your property listing

Legal basis: Contractual necessity — Art. 6(1)(b). Displaying your listing and contact details publicly is the core service you signed up for.

Platform security, fraud prevention, and content moderation

Legal basis: Legitimate interest — Art. 6(1)(f). Our legitimate interest is maintaining a safe, trustworthy, and legally compliant platform. We have assessed that this interest is not overridden by your rights.

Error monitoring and platform stability (Sentry)

Legal basis: Legitimate interest — Art. 6(1)(f). Detecting and resolving technical errors is necessary to operate a reliable service.

Cookieless analytics (Vercel Analytics)

Legal basis: Legitimate interest — Art. 6(1)(f). Vercel Analytics operates without cookies or persistent identifiers. It collects aggregated page view and performance data. You may object to this processing at any time by contacting us.

Product analytics (PostHog)

Legal basis: Consent — Art. 6(1)(a). PostHog is only activated with your explicit consent via our cookie banner. You may withdraw consent at any time.

Lead referral service

Legal basis: Consent — Art. 6(1)(a). Where you contact MyRent seeking property assistance and give your explicit consent at the time of your enquiry, we share your name, contact details, budget, and property requirements with relevant agents operating in Malta and Gozo who may contact you directly. You may withdraw consent at any time by contacting us at hello@myrent.mt, though we cannot recall data already shared with agents prior to withdrawal.

Compliance with legal obligations

Legal basis: Legal obligation — Art. 6(1)(c). Where Maltese or EU law requires us to retain or disclose data (for example, in response to a lawful authority request), we do so.

Automated decision-making

MyRent does not use automated decision-making or profiling that produces legal or similarly significant effects on individuals.

4. Data Sharing and Third Parties

MyRent does not sell, rent, or trade your personal information to third parties for marketing purposes.

Technology Service Providers

We use the following third-party processors to operate the platform. Each acts only on our documented instructions under a written Data Processing Agreement in accordance with GDPR Article 28.

Vercel — Application hosting

US-based. Transfer safeguard: EU-US Data Privacy Framework + Standard Contractual Clauses. Vercel Privacy Policy

Neon — PostgreSQL database hosting

Database stored in EU region (Frankfurt, AWS eu-central-1). No international transfer for stored data. Neon Privacy Policy

Vercel Analytics — Cookieless page view metrics

No cookies or persistent identifiers. IP addresses are not stored. Aggregated data only. Processed on Vercel infrastructure (DPF + SCCs apply).

PostHog — Product analytics (consent only)

EU instance (Frankfurt, AWS eu-central-1). Data does not leave the EU. Only activated with your consent. PostHog Privacy Policy

Sentry — Error monitoring

EU region (Frankfurt, Google Cloud). Transfer safeguard: Standard Contractual Clauses. Sentry Privacy Policy

Social Media Platforms

As described in our Terms of Service, MyRentmay share listing content — including agent names, contact details, property descriptions, and photographs — on social media platforms including Facebook, Instagram, TikTok, X (Twitter), and LinkedIn for marketing and promotional purposes. This constitutes a disclosure of personal data to these platforms as independent data controllers. Each platform's own privacy policy governs how they handle data once received. Where MyRentoperates business pages on these platforms, we may be joint controllers with the platform operator for certain analytics data (such as Facebook Page Insights).

If you do not wish your listing to be shared on social media, please contact us at hello@myrent.mt before or after your listing goes live.

5. Cookies and Tracking

MyRent uses cookies and similar technologies to provide essential functionality and, with your explicit consent, to understand how the site is used. Non-essential cookies are not set until you have given your consent via our cookie banner.

Essential Cookies (No consent required)

Authentication sessions, CSRF protection, redirect handling, and cookie consent storage. These are strictly necessary for the platform to function and cannot be disabled.

Analytics Cookies (Consent required)

PostHog product analytics cookies. Only set after you click "Accept" on the cookie banner. You can withdraw consent at any time. Vercel Analytics does not use cookies and does not require consent.

You can manage, change, or withdraw your cookie consent at any time on our Cookie Policy page or via your browser settings. Withdrawing consent does not affect the lawfulness of processing carried out before withdrawal.

6. Data Retention

We retain your personal data only for as long as necessary to fulfil the purposes set out in this policy or as required by law. The periods below apply per data category:

Active account data

Retained for the duration of your account. You may request deletion at any time.

Deleted account data

Personal data permanently deleted within 30 days of account deletion, unless a legal obligation requires longer retention.

Active listing data

Retained for the duration the listing is live on the platform.

Archived listing data

Retained for up to 24 months after removal for fraud prevention and platform integrity purposes, then permanently deleted.

Analytics data (PostHog)

Retained for up to 26 months from collection, then deleted.

Error logs (Sentry)

Retained for 90 days, then automatically deleted.

Cookie consent records

Retained for 3 years as evidence of consent, as required by applicable law.

7. Your GDPR Rights

Under GDPR and Malta's Data Protection Act, you have the following rights:

Right to Access

Request a copy of the personal data we hold about you.

Right to Rectification

Request correction of inaccurate or incomplete personal data.

Right to Erasure ("Right to be Forgotten")

Request deletion of your personal data where there is no longer a lawful basis for us to hold it, subject to legal retention obligations.

Right to Restriction

Request that we limit processing of your data in certain circumstances, for example while a dispute is resolved.

Right to Data Portability

Receive your data in a structured, commonly used, machine-readable format where processing is based on contract or consent.

Right to Object

Object to processing based on legitimate interests. We will stop processing unless we can demonstrate compelling legitimate grounds that override your rights.

Right to Withdraw Consent

Where processing is based on your consent (such as analytics cookies), you may withdraw that consent at any time via our cookie settings or by contacting us. Withdrawal does not affect the lawfulness of processing before withdrawal.

Right to Lodge a Complaint

Lodge a complaint with the IDPC at any time if you believe your rights have been violated — see Section 1 for full IDPC contact details. You do not need to contact us first before going to the IDPC.

To exercise any of these rights, contact us at hello@myrent.mt. We will respond within one month as required by GDPR Article 12. This period may be extended by two further months in complex cases — we will inform you if this applies.

8. Data Security

We implement reasonable technical and organisational measures to protect your personal data, including:

  • Encrypted data transmission (HTTPS/TLS)
  • Encrypted data storage at rest
  • Secure authentication and access controls
  • Limited access to personal data on a need-to-know basis
  • Use of certified, security-audited third-party processors (SOC 2, ISO 27001)

Data Breach Notification

In the event of a personal data breach that is likely to risk your rights and freedoms, we will notify the IDPC within 72 hours as required by GDPR Article 33, and notify affected individuals without undue delay where required by Article 34. No system is completely secure — we cannot guarantee absolute security but we take our obligations seriously and act promptly when incidents occur.

9. International Data Transfers

Our primary data storage (Neon database) and analytics (PostHog) are hosted in the EU (Frankfurt). The main international transfer is through Vercel, our hosting provider, which is US-based.

Where data is transferred outside the European Economic Area, we ensure appropriate safeguards are in place:

  • EU-US Data Privacy Framework: Vercel and Sentry are certified under the EU-US DPF adequacy decision adopted July 2023
  • Standard Contractual Clauses (SCCs): Used as a supplementary safeguard with all US-based providers
  • EU hosting: Neon (database) and PostHog (analytics) are hosted in Frankfurt, EU — no international transfer for this data

10. Listing Publication and Public Data

Publishing your property listing — including contact details, photos, and property description — is the core service MyRent provides. This processing is carried out on the basis of contractual necessity (GDPR Article 6(1)(b)): without it, we cannot provide the listing service you signed up for.

⚠️ What this means for your data

  • Your contact details (phone number, email) will be publicly visible to anyone visiting the platform
  • Your listing may be shared on social media platforms as described in Section 4
  • Once published, listing content may be indexed by search engines
  • You may receive contact from any person who views your listing

By posting a listing on MyRent, you acknowledge that:

  • You are solely responsible for managing communications from interested parties
  • The platform is not responsible for any misuse of your contact information by third parties once it has been displayed publicly
  • You warrant that any personal data of third parties included in your listing (for example, a joint landlord's details) has been shared with their knowledge and agreement

11. Children's Privacy

Our platform is not intended for individuals under the age of 18. We do not knowingly collect personal data from children. If you believe we have inadvertently collected such information, please contact us at hello@myrent.mt so we can promptly delete it.

12. Changes to This Policy

We may update this Privacy Policy from time to time. Where changes are material, we will notify you by email or by a prominent notice on the platform before the change takes effect. The "Last updated" date at the top of this page reflects the most recent revision. Continued use of the platform after changes take effect constitutes acceptance of the updated policy.
