Terms of Service

The terms that govern your use of MyRent, a listing platform for Malta and Gozo, operated by MyGroup Technologies.

01About these terms

MyRent (“MyRent”, “we”, “us”) is an online property listing platform for Malta and Gozo, operated by MyGroup Technologies. We allow approved agents and private landlords to advertise properties for rent or sale, and we allow users to browse those listings. We are not a property agent, broker, or intermediary; we simply display listings on behalf of the people who post them. These terms apply to everyone who uses MyRent, whether you are an agent, a landlord, a property seeker, or a casual visitor.

By using MyRent, you accept these terms in full. MyRent is a listing platform only and is not responsible for any interactions, agreements, or issues between users. All dealings between users are at your own risk.

02Acceptance of terms

By accessing or using MyRent, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using this platform. These terms constitute a legally binding agreement between you and MyGroup Technologies, operator of MyRent, and apply to all users, including property agents, private landlords, renters, buyers, and visitors, whether or not they create an account.

Continued use of MyRent after any change to these terms constitutes acceptance of those changes. We will provide at least 15 days’ notice before material changes take effect, by email or by prominent notice on the platform, in line with the EU Platform-to-Business Regulation (EU 2019/1150). It is your responsibility to review these terms periodically; if you do not agree with any changes, you should stop using the platform before they take effect.

03Platform role and limitations

MyRent operates solely as a listing platform that connects property owners and licensed agents with potential renters and buyers. MyRent is a hosting service provider within the meaning of the Electronic Commerce Act (Chapter 426) and the EU Digital Services Act (Regulation EU 2022/2065). Its role is limited to storing and displaying listing content provided by agents and landlords.

MyRent does not act “on behalf of” any landlord, agent, or other user in any legal sense. Where MyRent publishes a listing based on information provided by a landlord, it acts solely as an advertising service provider. No mandate under Maltese civil law arises from this arrangement.

The platform is NOT responsible for:

  • the accuracy, completeness, or legality of property listings;
  • any agreements, contracts, or transactions between users;
  • property viewings, inspections, or rental agreements;
  • the conduct or background of any user beyond our approval check process;
  • payment disputes, fraud, scams, or financial losses;
  • property conditions, safety, or legal compliance;
  • any damages, injuries, or losses arising from user interactions;
  • negotiating, advising on, or facilitating any property deal or lease.

All interactions, negotiations, and agreements occur directly between users. You are solely responsible for exercising due diligence, including verifying identities, property details, and the legitimacy of any offers before making payments or entering into agreements.

04User responsibilities

You must be at least 18 years old to register for or use MyRent. By using MyRent, you agree to, at all times:

  • provide accurate, current, and truthful information in your listings and profile;
  • conduct your own due diligence before entering any agreement;
  • verify property details, ownership, and legal status independently before relying on them;
  • not engage in fraudulent, misleading, or illegal activities on or through the platform;
  • respect the privacy and rights of other users;
  • comply with all applicable Maltese and EU laws;
  • keep your contact information up to date and accurate;
  • not use the platform to discriminate against any person in access to housing on grounds prohibited by the Equal Opportunities Act (Chapter 456), the Race Equality Directive (2000/43/EC), or any applicable anti-discrimination law.

05Approved agents

Only agents who have passed MyRent’s approval check may create and publish listings. The “Approved Agent” badge indicates only that MyRent has conducted a basic identity and legitimacy review of that agent at the time of approval, which may include checking identification documents and assessing whether the agent appears to be a legitimate business operator.

The “Approved Agent” badge does NOT mean:

  • the agent holds a valid PMA licence under Chapter 644 of the Laws of Malta;
  • the agent has been endorsed or approved by any government authority;
  • the agent’s listings are accurate, complete, or lawful;
  • MyRent monitors the agent’s ongoing conduct after the approval check;
  • MyRent guarantees the agent’s honesty, reliability, or professionalism.

We strongly recommend all users independently verify that any agent they deal with holds a valid licence issued by the Property Market Agency (PMA) at realestateregistration.gov.mt. MyRent bears no liability for the conduct of any approved agent before or after the check. You interact with all agents entirely at your own risk.

By accepting approved status, agents agree to:

  • hold a valid PMA licence where required by law;
  • provide their PMA licence number to MyRent on request;
  • notify MyRent immediately if their licence lapses or is suspended;
  • ensure all listings comply with Chapter 644 and the FIAU Implementing Procedures on AML/CFT;
  • provide accurate, truthful, and complete information in all listings;
  • promptly remove or update listings that are no longer available or accurate;
  • respond to enquiries in a professional and timely manner.

Failure to comply may result in immediate removal from the platform without notice or refund.

06Private landlord listings

Where a landlord submits property details to MyRent for publication, MyRent acts solely as an advertising service. The landlord acknowledges that MyRent is not their agent, mandatary, or representative in any legal sense. The landlord is solely responsible for:

  • the accuracy of all submitted property details, descriptions, images, and pricing;
  • compliance with the Housing Authority’s Private Residential Leases Act (Chapter 604), including mandatory lease registration within 30 days at rentregistration.mt;
  • compliance with occupancy regulations and all building safety requirements;
  • compliance with any applicable Malta Tourism Authority licensing requirements for short-term lets;
  • all other legal obligations as a landlord under Maltese law.

MyRent does not register leases, verify landlord ownership, or check planning permits.

07Listing accuracy, availability, and pricing

⚠️ Always verify before acting

Listings on MyRent are created and managed by agents and property owners, not by MyRent. Information may be inaccurate, outdated, or incomplete at any given time. Always independently verify all details directly with the listing agent or property owner before making any decision.

As a prospective renter, buyer, or browser, you acknowledge and agree that:

  • properties may already be rented, sold, reserved, or otherwise unavailable, even if the listing still appears active;
  • prices may be inaccurate, outdated, or subject to change without notice, as such human errors are normal and expected;
  • property details (descriptions, photos, amenities, measurements, floor plans, locations) may not reflect the current state of the property;
  • it is your sole responsibility to confirm all details (price, availability, condition, terms) directly with the agent or owner before any commitment or payment;
  • MyRent accepts no responsibility for the timeliness, accuracy, or completeness of information provided by agents or owners;
  • revealing or obtaining contact information through the platform is done entirely at your own risk.

Legal requirements MyRent does not verify:

  • Lease registration: under the Private Residential Leases Act (Chapter 604), unregistered residential leases may be null and void. Confirm any lease has been or will be registered at rentregistration.mt.
  • Short-term rental licensing: properties advertised for short-term rental may require a Holiday Furnished Premises licence from the Malta Tourism Authority under Chapter 409.
  • AIP permit requirements: non-EU buyers may need an Acquisition of Immovable Property (AIP) permit. MyRent does not verify AIP eligibility.

Each listing displays the contact details of the responsible agent or owner, and it is your sole responsibility to contact them directly. If you contact MyRent instead regarding an agent’s listing, MyRent is under no obligation to forward, relay, or respond to your enquiry within any timeframe, and accepts no responsibility for any missed opportunity, failed sale, lost rental, or expired offer that results. Never rely solely on information displayed on MyRent.

09Content rules and intellectual property

All listings, images, descriptions, and other content you submit must be lawful, respectful, and appropriate. You are fully responsible for the content you upload. Without limitation, you will NOT upload, post, or share any content that:

  • contains nudity, sexually explicit, or pornographic material;
  • depicts minors in any sexualised, unsafe, or exploitative way;
  • includes violent, threatening, or abusive imagery or language, including glorification of self-harm or harm to others;
  • is hateful, harassing, or discriminatory towards any person or group on the basis of race, ethnicity, nationality, religion, gender, sexual orientation, disability, or any other protected characteristic;
  • is defamatory, misleading, fraudulent, or otherwise deceptive;
  • promotes illegal activities or violates any applicable law;
  • infringes any third-party rights, including copyright, trademarks, or privacy;
  • contains spam, scams, or links to malicious or harmful content.

Content licence and usage rights

By uploading, posting, or publishing any content on MyRent (including listing descriptions, photographs, images, videos, and floor plans) you grant MyRent a non-exclusive, worldwide, royalty-free, transferable, sublicensable licence to use, reproduce, modify, adapt, publish, display, distribute, and promote that content in any media or format, for any purpose related to MyRent’s operations, including:

  • displaying your listings on MyRent and any affiliated websites or apps;
  • sharing listings on social media platforms (including Facebook, Instagram, TikTok, X, and LinkedIn);
  • using listing content in advertising campaigns, marketing materials, and promotional content, online or offline;
  • featuring listings in newsletters, emails, blog posts, or other communications;
  • creating derivative works such as cropped images, thumbnails, or compilations for promotional purposes.

This licence continues for as long as the content remains on the platform and survives deletion for any materials already used in published campaigns. You represent and warrant that you own or have the necessary rights to grant this licence for all content you submit.

Copyright notice and takedown

If you believe your intellectual property rights are infringed by content on MyRent, notify us at hello@myrent.mt with: your identity and contact details; a description of the claimed infringing content and its URL on MyRent; a statement that the use is unauthorised; and a good-faith statement that your notice is accurate. We will investigate and act expeditiously on substantiated notices.

10Notice and action (Digital Services Act)

MyRent operates a notice-and-action mechanism as required by Article 16 of the EU Digital Services Act (Regulation EU 2022/2065). Any person may report content they believe to be illegal or in violation of these terms by contacting hello@myrent.mt or using the report function on any listing. Reports should include the URL of the content, an explanation of why it is believed to be illegal or in breach, your contact information, and a statement that the report is made in good faith.

We will assess all reports and take appropriate action without undue delay, and notify the reporter of the outcome where contact details are provided. Where content or conduct may constitute a criminal offence involving a threat to life or safety, we will notify the relevant Maltese authorities.

11Content moderation and account actions

MyRent reserves the right to:

  • moderate, edit, or remove any listing or content at our discretion;
  • suspend or terminate user accounts;
  • block users who violate these terms or engage in suspicious activity;
  • refuse service to anyone for any reason;
  • modify or discontinue any aspect of the platform without notice;
  • remove or hide listings and content we consider inappropriate, misleading, or harmful, at our sole discretion.

When we remove content, restrict a listing, or suspend or terminate an account, we will: (1) notify the affected user by email stating the reason; (2) give the user an opportunity to respond where the situation is not urgent; and (3) implement the action without prior notice only where there is a serious or urgent reason, such as illegal content, fraud, or risk of harm. This fulfils our obligations under Article 17 of the Digital Services Act. Account removal, suspension, or restriction does not entitle users to any refund, compensation, or reinstatement.

12Housing Authority and lease registration

Malta’s Private Residential Leases Act (Chapter 604) requires all residential lease contracts to be registered with the Housing Authority within 30 days. Unregistered contracts may be legally null and void. MyRent is not involved in any lease agreement and does not register leases on behalf of any party; all landlords and agents are solely responsible for compliance. Users are directed to rentregistration.mt for registration and housingauthority.gov.mt for further information.

13Fraud, scams, and user interactions

Important disclaimer

While MyRent conducts approval checks on agents before granting posting access, we do NOT guarantee the accuracy of individual listings, conduct property inspections, or verify the details of any specific transaction. All interactions between users are at your own risk.

MyRent is not responsible for and expressly disclaims all liability for:

  • fraudulent listings, scams, or deceptive practices by users;
  • financial losses from deposits, payments, or transactions;
  • identity theft or impersonation by other users;
  • properties that do not exist or are misrepresented;
  • disputes, disagreements, or conflicts between users;
  • any criminal activity conducted through or facilitated by the platform.

You are solely responsible for verifying the identity of users, the legitimacy of listings, and the safety of any property before making payments or entering agreements. Always meet in safe public places, never send money without verification, and report suspicious activity to local authorities.

14Data protection and privacy

MyGroup Technologies (operator of MyRent) is the data controller of all personal data collected through the platform. Data is processed in accordance with the General Data Protection Regulation (EU 2016/679) and Malta’s Data Protection Act (Chapter 586). You have the rights of access, rectification, erasure, restriction, portability, and objection. 15Property search and lead referral

Where you contact MyRent seeking property assistance (by email, contact form, or any other means), MyRent may offer to connect you with relevant agents operating in Malta and Gozo. This service is only provided with your explicit consent, given at the time of your enquiry. By confirming consent, you agree that MyRent may share your name, contact details, budget, and property requirements with relevant agents who may then contact you directly.

How this service works

  • MyRent charges agents a fee for receiving leads, a commercial arrangement between MyRent and the agent;
  • we only share your details with agents after you have given explicit consent; your information is never shared without your permission;
  • our sole obligation is to make the introduction in good faith, matching real people with real agents based on the information provided. Our responsibility ends at the introduction.

No guarantees for property seekers. MyRent does not guarantee that any agent will find you a suitable property, respond within any timeframe, offer matching properties, or provide a satisfactory level of service, and accepts no liability for any interaction or outcome with any agent introduced.

No guarantees for agents. A lead is a person who has expressed interest in finding a property, nothing more. The fee paid by the agent is for the introduction itself, not for any guaranteed outcome, and leads are non-refundable regardless of whether the lead converts. Once the introduction is made, you deal directly with the agent; MyRent is not a party to any negotiation, agreement, viewing, or transaction that follows.

16Anti-money laundering disclaimer

MyRent is a listing platform and is not a “subject person” under the Prevention of Money Laundering Act (Chapter 373) or the Prevention of Money Laundering and Funding of Terrorism Regulations (SL 373.01). MyRent does not handle deposits or transaction funds, or act as intermediary in any financial transaction. Licensed agents using this platform are themselves subject persons under applicable AML legislation and are solely responsible for their own customer due diligence, Know Your Customer obligations, and FIAU compliance. We strongly recommend all users engage a notary and/or licensed property professional for any actual property transaction.

17Limitation of liability

To the maximum extent permitted by law, MyRent and its operators shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from your use of the platform or interactions with other users. This includes but is not limited to:

  • financial losses from fraud, scams, or failed transactions;
  • property damage or personal injury;
  • loss of data or service interruptions beyond our reasonable control;
  • legal disputes between users;
  • errors, interruptions, or unavailability of the platform;
  • third-party actions or services;
  • money spent on the platform (featured listings, credits, subscriptions, boosts, or any paid service) that did not produce the results you expected;
  • loss of business, leads, rental income, potential tenants or buyers, or any other commercial opportunity;
  • outcomes arising from contact information revealed or obtained through the platform, including unwanted contact or failed negotiations;
  • reliance on listing information (prices, availability, descriptions, or photos) that turns out to be inaccurate, incomplete, or outdated;
  • properties that are listed but already taken, reserved, rented, or otherwise unavailable;
  • any costs, expenses, or time spent using the platform, including travel to view properties or legal fees.

You expressly agree that your use of MyRent and any money spent on the platform is entirely at your own risk. MyRent provides its services on an “as is” and “as available” basis, without warranties of any kind, express or implied. Nothing in these terms limits our liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence, or any liability that cannot be excluded under Maltese or EU law.

18Indemnification

You agree to indemnify, defend, and hold harmless MyRent and its operators, directors, employees, and affiliates from any and all claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

  • your use of the platform, including any paid services or features;
  • your violation of these terms or any applicable law;
  • your interactions, agreements, or disputes with other users;
  • content you post, including listings, descriptions, images, or messages;
  • any third-party claim related to your use of the platform or your listings;
  • any dissatisfaction with the results or performance of paid services, featured listings, or any other platform feature.

19Third-party services

MyRent uses third-party services for hosting, analytics, and platform functionality. We are not responsible for the practices, security, or policies of these third-party providers. While we take reasonable precautions, we cannot guarantee the security of your data when it is stored or processed by third-party services. The providers we use, and the safeguards that apply, are described in our Privacy Policy.

20Governing law and disputes

These Terms of Service are governed by the laws of Malta and applicable EU regulations. The courts of Malta have exclusive jurisdiction over any dispute arising from or in connection with these terms, subject to the following: users who are consumers within the meaning of EU consumer protection law may also bring claims in the courts of their EU country of residence, where permitted by applicable law. Users may also contact the Malta Competition and Consumer Affairs Authority (MCCAA) at mccaa.org.mt for consumer dispute resolution.

21General

  • Severability. If any provision of these terms is found invalid, illegal, or unenforceable, the remaining provisions continue in full force and effect.
  • Waiver. Our failure to exercise or enforce any right or provision is not a waiver of that right or provision.
  • Force majeure. MyRent is not liable for failure or delay in performance caused by circumstances beyond its reasonable control, including natural disasters, pandemic, government action, power failure, telecommunications failure, or cyberattack.
  • Assignment. MyRent may assign its rights and obligations in connection with a merger, acquisition, or sale of all or substantially all of its assets, provided the incoming party accepts these same data protection obligations.
  • Notices. Formal communications from MyRent to users are sent to the registered email address and are deemed received 24 hours after sending.
